Terms of Service
The agreement that governs your use of Holler 24/7 — the AI-powered answering and virtual front-desk service that makes sure your business never misses a holler.
General Provisions
1.1 Who we are
These Terms of Service (the "Terms") govern your access to and use of the website at holler247.com, the Holler 24/7 web application and dashboard, and all related answering, messaging, booking and reporting services (together, the "Service"). The Service is operated by:

We refer to this entity below as "Holler 24/7", "we", "us", or "our". We refer to you, the account holder, as "you" or the "Customer".
1.2 Accepting these Terms
By creating an account, starting a trial, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you may not use the Service. If you are using the Service on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
1.3 Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify you by email or through the dashboard before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not agree, you should stop using the Service and may cancel your subscription.
1.4 Additional terms
Some features or plans may carry their own additional terms, order forms, or a Data Processing Agreement, which are incorporated into these Terms by reference. Where an additional term conflicts with these Terms for that specific feature, the additional term controls.
The Service
2.1 What Holler 24/7 does
Holler 24/7 provides AI-powered call answering and a virtual front desk built for home-service contractors — including roofing, HVAC, plumbing, electrical, and storm, hail, and flood restoration businesses. Depending on your plan, the Service may include:
- 24/7 answering of inbound phone calls by an AI voice agent configured to your business;
- Handling of SMS text messages and email inquiries;
- Web chat on your website (included on higher-tier plans only);
- Appointment and job booking, and routing of jobs to the right crew;
- Call recording, transcription, and lead capture;
- Logging of contacts and jobs to your connected CRM or field-service software (for example HubSpot, Jobber, ServiceTitan, or Housecall Pro); and
- Call reports, summaries, and usage statistics.
The specific features, included minutes, and limits of your plan are those presented to you at checkout and described at holler247.com. Certain features are not available on every plan.
2.2 Underlying technology
The Service is delivered using our own configuration together with third-party voice AI, telephony, and messaging infrastructure that we license. We may change, upgrade, or replace this underlying technology at any time, provided we do not materially reduce the core functionality of your plan.
2.3 Availability
We aim to keep the Service available around the clock, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, carrier or vendor outages, or other factors outside our reasonable control.
Accounts
3.1 Creating an account
You need an account to use the Service. You agree to provide accurate, complete, and current information and to keep it up to date. You must be at least 18 years old and able to enter into a binding contract.
3.2 Account security
You are responsible for keeping your login credentials confidential and for all activity that happens under your account, whether or not you authorized it. Tell us immediately at hello@holler247.com if you suspect any unauthorized use.
3.3 Plans
We offer several subscription tiers — currently Taster, Growth, and Scale — each with its own features, included minutes, and pricing as shown at checkout and at holler247.com. Some plans include a limited trial. Overage usage beyond your plan's included minutes is billed at the per-minute rate stated for your plan.
3.4 Suspension and closure
We may suspend, restrict, or close your account, with or without notice, if you breach these Terms, fail to pay amounts due, or engage in activity that is unlawful or that could harm the Service, us, your callers, or other customers. Where practical, we will give you notice and an opportunity to resolve the issue first.
Your Responsibilities
4.1 Compliance with the law
You are responsible for making sure your use of the Service complies with all laws that apply to you and to the people you contact, including but not limited to:
- The federal Telephone Consumer Protection Act (TCPA) and the Telemarketing Sales Rule (TSR), including rules on prior consent, calling times, and the National Do-Not-Call Registry;
- Federal and state rules on call recording and monitoring consent, including two-party (all-party) consent requirements in states that impose them;
- State telemarketing, robocall, and automated-messaging laws, and applicable messaging (SMS) carrier and industry rules; and
- The EU General Data Protection Regulation (GDPR) and related rules, if you use the Service to contact individuals in the European Economic Area or the United Kingdom.
4.2 Consent and contact data
You alone are responsible for:
- Obtaining any consent required before calls, texts, or recordings are made;
- Honoring do-not-call and opt-out requests, and keeping your contact and campaign lists lawful and accurate;
- Providing any legally required notices to the people whose information you process through the Service; and
- Ensuring you have the right to upload and use any contact lists, scripts, or recordings you provide.
We are not responsible for your failure to meet these obligations.
4.3 Prohibited use
You may not use the Service to:
- Make calls or send messages for unlawful, fraudulent, abusive, harassing, or deceptive purposes;
- Transmit obscene, defamatory, threatening, or infringing content;
- Process the data of minors without proper consent;
- Upload malicious code, or attempt to probe, scan, or breach the security of the Service;
- Reverse engineer, decompile, or attempt to extract the source code or models behind the Service;
- Interfere with the Service or with other customers' use of it; or
- Do anything else that violates applicable law or these Terms.
4.4 AI disclosure
You are responsible for ensuring that callers and message recipients are told, clearly and where required by law, that they are interacting with an automated AI system rather than a live person. You control the scripts and configuration and act as the deployer of the AI agent.
Fees & Billing
5.1 Fees
Paid plans require payment of the fees shown at checkout. Your plan fee, billing period, included minutes, and per-minute overage rate are those presented when you subscribe and are also summarized at holler247.com.
5.2 Payment
Payments are processed by our third-party payment provider, Stripe, Inc. By providing a payment method, you authorize us to charge your recurring plan fee and any usage-based charges (such as overage minutes) as they accrue. If a payment fails, we may suspend the Service until the balance is resolved.
5.3 Trials
Where a plan includes a trial (such as the Taster tier), the trial runs for the stated period and usage cap. Unless you cancel before the trial ends, your plan may convert to a paid subscription at the then-current rate.
5.4 Automatic renewal
Subscriptions renew automatically at the end of each billing period at the rate then in effect, unless you cancel before the renewal date. You can cancel at any time from your account settings or by contacting us.
5.5 Refunds
Except where required by law, fees already paid — including for the unused portion of a billing period — are non-refundable. Usage-based charges that have already accrued are payable in full. No refund is due if we close your account for a breach of these Terms.
5.6 Taxes and surcharges
Fees are exclusive of taxes. You are responsible for any sales, use, telecommunications, or similar taxes, and any regulatory fees or surcharges that apply to the Service, except for taxes based on our net income. Where required, we may collect and remit such amounts and add them to your invoice.
5.7 Price changes
We may change our fees. We will give you advance notice of any change, which will take effect at your next renewal. Continuing to use the Service after a price change takes effect means you accept it; if you don't, you may cancel before it applies.
Calls & Messaging
Phone calls, text messages, and other communications handled through the Service are carried over third-party telephone and messaging networks and are subject to those carriers' terms, coverage, and availability. We do not guarantee that any particular call or message will be connected, delivered, or delivered without delay, and we are not liable for carrier failures, number-blocking, spam filtering, or misrouting outside our reasonable control.
Telephone numbers provisioned for your use remain subject to carrier and regulatory requirements. You may not use those numbers for any purpose prohibited by this agreement, by the underlying carriers, or by law.
Intellectual Property
7.1 Our rights
The Service, the Holler 24/7 name, logo, brand, software, interfaces, documentation, and all related materials are owned by us or our licensors and are protected by intellectual property laws. These Terms do not transfer any of those rights to you.
7.2 Your license
As long as you comply with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your own business purposes, in line with the plan you purchased and our documentation.
7.3 Your content
You keep ownership of the content you provide — scripts, greetings, business information, contact lists, recordings, and similar material ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and use Your Content solely to operate, provide, secure, and improve the Service, consistent with our privacy commitments and applicable law.
7.4 Feedback
If you send us suggestions or feedback about the Service, we may use it freely, without restriction or any obligation to you.
7.5 Restrictions
Except as permitted by law or expressly allowed here, you may not copy, resell, sublicense, rent, or redistribute the Service; create derivative works from it; or remove or alter any of its proprietary notices.
Data & Privacy
8.1 Our role
How we handle personal information is described in our Privacy Policy. In general, we handle your own account information as a business in our own right, and we handle information about the people you contact (such as caller phone numbers, recordings, and transcripts) on your behalf and under your instructions as part of providing the Service.
8.2 Your role
For the information about callers and contacts that you process through the Service, you are responsible for having a lawful basis to collect and use it, for providing required notices and disclosures, for honoring individuals' rights and opt-out requests, and — where GDPR or similar laws apply — for entering into a Data Processing Agreement with us and meeting your obligations as a data controller.
8.3 Recordings and sub-processors
Where the Service records or transcribes calls, you are responsible for any consent those recordings require. We use vetted third-party providers (including our underlying voice AI, telephony, messaging, and hosting vendors) to deliver the Service, and we require them to protect information consistent with our commitments to you.
Disclaimers & Limitation of Liability
9.1 "As is"
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that calls or messages will always be delivered, or that AI-generated responses, transcripts, or bookings will be accurate or complete. You are responsible for reviewing important leads, bookings, and outputs.
9.2 No indirect damages
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising out of or relating to the Service, even if we were advised such damages were possible.
9.3 Liability cap
To the fullest extent permitted by law, our total liability for all claims arising out of or relating to these Terms or the Service will not exceed the greater of (a) the fees you paid us in the three (3) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100).
Indemnification
You agree to defend, indemnify, and hold harmless Holler 24/7 and its affiliates, licensors, vendors, and their officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use or misuse of the Service;
- Your breach of these Terms or any additional terms;
- Your Content, scripts, recordings, or contact lists;
- Your failure to comply with applicable law, including the TCPA, TSR, call-recording consent laws, or data-protection laws; and
- Any dispute between you and a caller, contact, customer, or other third party related to your use of the Service.
Term & Termination
11.1 Term
These Terms apply from the moment you first access or use the Service and continue until terminated as described here.
11.2 Termination by you
You may stop using the Service and close your account at any time through your account settings or by contacting hello@holler247.com. Unless required by law, no refund is due for unused time.
11.3 Termination by us
We may suspend or close your account for breach of these Terms, non-payment, or activity that could harm the Service or others, as described in Section 3.4.
11.4 What survives
On termination, your right to use the Service ends immediately, any unpaid fees remain due, and the sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — continue to apply.
Force Majeure
Neither party is liable for any delay or failure to perform (other than payment obligations) caused by events beyond its reasonable control, including natural disasters, severe weather, pandemics, government action, labor disputes, power or internet outages, carrier or vendor failures, and acts of terrorism or war.
Governing Law & Disputes
13.1 Governing law
These Terms are governed by the laws of the State of Oklahoma and applicable U.S. federal law, without regard to conflict-of-laws rules.
13.2 Informal resolution
Before starting formal proceedings, please contact us at hello@holler247.com so we can try to resolve the issue. Most concerns can be settled quickly this way.
13.3 Venue
If a dispute cannot be resolved informally, you agree that it will be brought exclusively in the state or federal courts located in Oklahoma County, Oklahoma, and you consent to the personal jurisdiction of those courts.
General
14.1 Entire agreement
These Terms, together with any additional terms, order forms, and our Privacy Policy, are the entire agreement between you and us about the Service and replace any prior understandings on the subject.
14.2 Assignment
You may not assign or transfer these Terms without our written consent. We may assign them, for example in connection with a merger, acquisition, or sale of assets.
14.3 Severability
If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the rest of these Terms will stay in effect.
14.4 Waiver
Our failure to enforce any right or provision is not a waiver of it.
14.5 Notices
We may give you notices by email, through the dashboard, or by other reasonable means. You may send notices to us at hello@holler247.com or the address in Section 1.1.
14.6 Independent parties
These Terms do not create any employment, agency, partnership, or joint venture between you and us, and you have no authority to bind us.
